The City has received an application for a proposed ancillary dwelling (granny flat) at 70 Orange Avenue, Upper Swan. The details of the proposal are as follows:

  • 73 m², two bedroom ancillary dwelling

The applicant is seeking approval for reduced lot boundary setback than what is permitted “as of right” under the Residential Design Codes (R-Codes). The City has discretion to approve variations but seeks neighbour feedback as part of the assessment process. The proposal includes the following departure:

  • A setback of 3m in lieu of the 7.5m permitted as of right

As a result, the proposal requires an assessment against the applicable design principles which read:

Buildings set back from lot boundaries or adjacent buildings on the same lot so as to:

  • reduce impacts of building bulk on adjoining properties;

  • provide adequate sunlight and ventilation to the building and open spaces on the site and adjoining properties; and

  • minimise the extent of overlooking and resultant loss of privacy on adjoining properties
