The City has received an application for a ‘Transport Depot’ at Lot 756 (No.36) Wintergreene Drive, Bennett Springs.
The proponent lodged seeking approval for five (5) commercial vehicles comprising three (3) prime movers and two (2) rigid non-articulated vehicles. They are proposed to be parked within in the rear of the lot.
This proposal varies ‘Schedule 14 – Parking of Commercial Vehicle(s) Provisions’ of the City’s Local Planning Scheme No.17 (LPS17) which specifies a maximum of one (1) commercial vehicle and no trailers for residentially zoned lots greater than 750m2 in area.
In light of the proposed vehicles exceeding that which could ordinarily be determined under ‘Part 5.10 Parking of Commercial Vehicles’ and Schedule 14 of LPS17, City Staff consider this use to be a ‘Transport Depot’.
The scheme defines a ‘Transport Depot’ as:
“Means a premises, or a portion of premises, used for the parking or garaging of commercial vehicles, and:
- May include the maintenance and refuelling of those vehicles and the storage of goods brought to the premises by those vehicles, provided that those activities are ancillary to the parking or garaging of the commercial vehicles; and
- May include the transfer of goods or persons from one motor vehicle to another
But does not include the parking or garaging of commercial vehicles approved pursuant to clause 5.10 of the Scheme”.
The City is currently unable to contemplate vehicular access off of Marshal Road and consequently, vehicular access will instead be contemplated from a portion of the presently unconstructed link road from Wintergreene Drive.
Prior to Council giving consideration to the proposal, comments from surrounding owners are sought.
