The City has received a proposal for two Accessible Dwellings at 47 Bishop Road, Middle Swan.
As ‘Accessible Dwellings’ are not a defined use under the City’s Local Planning Scheme No. 17 (LPS17), the proposal is considered a ‘Use Not Listed’. In accordance with the Planning and Development (Local Planning Schemes) Regulations 2015, the application is being advertised to landowners and occupiers within a 200-metre radius of the subject site.
In addition to being a ‘Use Not Listed’, the applicant is seeking the following variation to the permitted “as of right”, primary street setback under the Residential Design Codes (R-Codes).
- 3.3 Street Setbacks
The proposal includes a portion of the dwellings being setback 3 metres from the primary street boundary, which represents approximately 40% of the lot frontage, in lieu of the permitted “as of right” 30%.
As a result, the proposal requires assessment against the relevant R-Code design principles at the City’s discretion.
The City invites your comments on the proposed use and setback as an affected landowner.
