The City has received a development application for a proposed single house on Lot 599 (No.21) Magnet View, MIDVALE. The applicant is proposing an as-of-right variation to build a boundary wall on the rear of the property. The details of the proposed development are as follows:
Area: 222.72m2
Wall height: 2.435m
Overall height: 5.2m
The application indicates that part of the proposed new dwelling on the subject property is planned to be built up to the rear lot boundary, which does not comply with the ‘deemed-to-comply’ provisions of the RMD Codes related to boundary setbacks (as seen on the associated site plans). The boundary wall is 8.29m in length and 2.345m in height.
The City will conduct an alternative merit-based assessment against the design principles of the Residential Design Codes - 5.1.3 Lot boundary setbacks:

- does not have any adverse impact on the amenity of the adjoining property;
- reduce impacts of building bulk on adjoining properties;
- ensures sunlight to major openings to habitable rooms and outdoor living
- areas for adjoining properties is not restricted
Prior to the Council giving consideration to the proposal, comments from the surrounding owners are being sought.
