The City has received the abovementioned proposal for consideration.

You are invited to comment on the above Planning Application before the City of Swan considers the proposal. The subject lot is located within the “Guildford Historic Town” which is on the State Register of Heritage Places protected by the Heritage Act 2018 and is designated as the Guildford Heritage Area under the City of Swan Local Planning Scheme.

The applicant is seeking development approval for the following additions to the existing dwelling on the site at Lot 3 (No.38) Market Street, Guildford.

Details of the proposal are as follows:

  • Proposed single-storey non-habitable outbuilding comprising a double garage and workshop area;
  • Proposed 1.8m high solid recycled red brick fence with automatic sliding gate facing Swan Street West;
  • Second driveway and crossover proposed to Swan Street West;
  • Removal of three existing trees (2 x Melaleuca Linariifolio and 1 x Citrus Lemon).

The proposal includes a variation to the ‘deemed-to-comply’ measures contained within the Guildford Heritage Policy.

Varies 8.4.2 Scale and Form in the following manner:

  • By proposing a single storey plate height of 2.6m in lieu of a minimum of 3m.

The Guildford policy provides performance criteria setting out how a development proposal can meet the intent of the policy statement against each measure.

The proposal varies the ‘deemed-to-comply’ requirements within State Planning Policy 7.3 Residential Design Codes (R-Codes) in the following manner.

  • Varies Clause 5.2.5 Sightlines by having a fence that is not truncated within 1.5m of the proposed second driveway;
  • Varies Clause 5.3.5 Vehicular Access by proposing driveways which exceed in aggregate 9m for the one property;
  • Varies Clause 5.4.3 Outbuildings by proposing a large outbuilding which exceeds 60m2 in area being approximately 98.1m2, exceeds wall height requirement of 2.4m being a minimum of 2.6m and exceeds the ridge height requirement of 4.2m being 5.1m.

The associated performance criteria ‘design principles’ against the above is as follows.

Clause 5.2.5 Sightlines:

“Unobstructed sightlines provided at vehicle access points to ensure safety and visibility along vehicle access ways, streets, rights-of-way, communal streets, crossovers, and footpaths.”

Clause 5.3.5 Vehicular Access:

‘Vehicular access provided for each development site to provide:

  • vehicle access safety;
  • reduced impact of access points on the streetscape;
  • legible access;
  • pedestrian safety;
  • minimal crossovers; and
  • high quality landscaping features’

Clause 5.4.3 Outbuildings

‘Outbuildings that do not detract from the streetscape or the visual amenity of residents or neighbouring properties’.

The application package includes development plans, heritage impact statement and character impact assessment and arborist report.

Prior to the determination of application, the City wishes to formally invite you to provide a submission on this proposal.
