The City has received an application for a single house at Lot 8743 (No.34) Iwasaki Crest, Ellenbrook.

The applicant is seeking approval for a reduced setback than what is permitted “as of right” under the Residential Design Codes (R-Codes).

The proposal includes the following departures:

Lot Boundary Setback (5.1.3)

  • A boundary wall (0m setback), in lieu of the 1m minimum permitted as of right.

As a result, the proposal requires an assessment against the applicable design principles which read:

P3.2 Buildings built up to boundaries (other than the street boundary) where this:

  • makes more effective use of space for enhanced privacy for the occupant/s or outdoor living areas
  • does not compromise the design principle contained in clause 5.1.3 regarding sunlight, solar access and privacy
  • does not have any adverse impact on the amenity of the adjoining property
  • ensures sunlight to major openings to habitable rooms and outdoor living areas for adjoining properties is not restricted
  • positively contributes to the prevailing or future development context and streetscape as outlined in the local planning framework.

The City has discretion to approve variations but seeks neighbour feedback as part of the assessment process.
