The lot is zoned Urban under the Metropolitan Region Scheme and Special Use Zone 10 with a density code of R30 under the City’s Local Planning Scheme No.17.

The proposal consists of the following particulars (if relevant):

  • Colorbond patio, 13.6m in length, 2.35m in width and 3.074m in total height.

This proposal varies the deemed-to-comply provisions of ‘Clause 5.1.3 Lot Boundary Setbacks’ by virtue of proposing a 0.5m setback in lieu of the required 1.5m.

The associated performance criteria of 5.1.3 Lot Boundary Setbacks is as follows:

Buildings set back from lot boundaries or adjacent buildings on the same lot so as to:

  • reduce impacts of building bulk on adjoining properties
  • provide adequate sunlight and ventilation to the building and open spaces on the site and adjoining properties
  • minimise the extent of overlooking and resultant loss of privacy on adjoining properties.
