The City has received a development application for the construction of a grouped and ancillary dwelling in a dual-key configuration, together with a separate grouped dwelling to its south at Lot 808 (No. 13) Mather Court, Midvale.

The lot has an area of 581m² and is zoned Residential Development with an assessment zoning of Residential R40 under the City’s Local Planning Scheme No. 17 and the Farrall Road Local Structure Plan.

The application includes variations to the deemed-to-comply requirements of the Residential Design Codes. These are as follows:

C1.1.1 and C1.1.2 – Primary Garden Area

  • Unit 1 (consisting of the ancillary dwelling) provides a reduced primary garden area (31.54m²), together with no secondary compensatory open space in lieu of the 40m2 requirement.

C1.2.1 – Soft Landscaping

  • Unit 1 provides 13.12% soft landscaping in lieu of the minimum 15% required.

C3.1.1 – Site Cover

  • Unit 1 exceeds the maximum site cover requirement, with 64.23% provided in lieu of the maximum 65% (minor variation when considered with allocated site area).

C3.4.6 – Internal Setbacks (Grouped Dwellings)

The City has discretion to approve variations to the deemed-to-comply requirements having regard to the relevant Design Principles. Prior to determining this application, the City is seeking comments from surrounding landowners.
