The City has received a development approval application for eight grouped dwellings at Lot 97 & 96 (Nos. 43 & 45) Clipper Drive, Ballajura.

The applicant is seeking variations to the following clauses of State Planning Policy 7.3 – Residential Design Codes (R-Codes):

  • Clause 3.4.1: According to Table 3.4a of the R-Codes, walls with a height between 7.1m and 10m require a 3m setback from shared lot boundaries. While walls with a height less than 7.1m requires a setback of 1.5mThe proposal includes the following variations:
    • Unit 1: 7.6m high wall with a 1.4m setback. (side setback)
    • Unit 2: 7.2m high wall with a 1.5m setback. (side setback)
    • Unit 4: 7.2m high wall with a 1.6m setback. (side setback)
    • Unit 4: 7.7m high wall with a 2.7m setback. (side setback)
    • Unit 4: 7.7m high wall with a 1.6m setback. (rear setback
  • Clause 3.4.2: Per the deemed-to-comply provisions of the R-Codes, second-story walls exceeding 14m in length are required to have a 3m setback from shared lot boundaries.

The proposal includes:

    • Unit 5: wall length of 18.3m with a 1.5m setback. (rear setback)
