The City has received a planning application for a grouped dwelling at Lot 2 (No.79A) Meadowview Drive, Ballajura.
The lot is zoned Urban under the Metropolitan Region Scheme and Residential with a density code of R17.5/35 under the City’s Local Planning Scheme No.17.
This proposal includes variations to the deemed-to-comply provisions of the Residential Design Codes that may impact the surrounding properties. The primary variations are as follows:
C3.4.1 Lot Boundary Setback
The proposal varies the deemed-to-comply provisions of the Residential Design Codes by proposing a 3.544m high wall along the northern lot boundary with a setback of 1.0m, in lieu of the required 1.5m setback.
The associated performance criteria of C3.4.1 Lot Boundary Setback are as follow:
P3.4.1 Lot boundary setbacks reinforce the location’s streetscape character and are consistent with the existing or desired built form local character.
P3.4.2 The setback of development from lot boundaries provides a transition between sites with different land uses or intensity of development.
P3.4.3 Buildings are set back from lot boundaries or adjacent buildings on the same lot to:
- provide adequate solar access and natural ventilation to the building and open spaces on the site and adjoining properties; and
- address the potential for overlooking and resultant loss of privacy on adjoining properties.
C3.4.4 Boundary Walls
The proposal varies the deemed to comply provisions by virtue of proposing a boundary wall along the eastern lot boundary. Boundary walls are not permitted as of right within areas coded R17.5.
The associated performance criteria of C3.4.4 Boundary Walls are as follow:
P3.4.4 Buildings are built up to lot boundaries where this:
- makes more effective use of space for primary garden areas and/or private open space;
- maintains adequate solar access to major openings and private open space of adjoining properties; and
- contributes positively to the prevailing or future development context and streetscape as outlined in the local planning framework.
