The City has received a development application to amend the terms of a development approval issued for the ‘Use Not Listed: Private Psychiatric Hostel’ at Lot 10 (No.40) John Street, Midland.


The original approval to change the use of six (6) grouped dwellings to a ‘Use Not Listed: Private Psychiatric Hostel’ was granted on 19 August 2024 subject to conditions and was valid for a period of 12 months from the date of determination, whereupon the approval would expire and the use would cease unless further approval had been obtained.


Nearing the end of this 12-month period, the applicant sought development approval to extend the term of approval from 19 August 2025 until 7 May 2026. This was presented to Council and was approved on 10 September 2025.


The applicant has now lodged the subject application with the City of Swan and is seeking two amendments to the terms of approval, notably:

1) Modify condition 1 so that the time limitation is deleted, allowing approval of the use in a permanent manner until no longer required; and

2) Modify condition 3, by deleting part (h), to remove reference to the requirement for a quarterly meeting between Roshana Pty Ltd, the City of Swan and community representatives to review operational performance


Prior to the City presenting this item at an Ordinary Meeting of Council, we wish to invite you to comment on the proposal.
