The City has received a development application for six (6) Multiple Dwellings located at 118 Morrison Road, Midland. The proposal includes variations to the side setback and visual privacy requirements in accordance with the Residential Design Codes (RCodes). These variations are detailed below:
Clause 2.4 (Side and Rear Setbacks) and Table 2.1 (Primary Controls) of the Residential Design Codes (Volume 2)
- The development proposes a gatehouse (open sided structure) on the western boundary which is setback 0.5m from the boundary. Table 2.1 stipulates that the side setback requirement is 3m.
- The development proposes a boundary wall to multiple side boundaries for the individual storerooms and the bin store for the development, to the eastern, southern and western boundaries of the property. Table 2.1 stipulates that boundary walls may be permitted up to two storeys in height, for 2/3 of the boundary, to one side only
Because the development does not meet the requirements of Table 2.1, the City is undertaking a “Element Objectives” assessment and is seeking feedback from adjacent landowners regarding the proposal. For your information, the Element Objectives are as follows:
O 2.4.1 Building boundary setbacks provide for adequate separation between neighbouring properties.
O 2.4.2 Building boundary setbacks are consistent with the existing streetscape pattern or the desired streetscape character.
O 2.4.3 The setback of development from side and rear boundaries enables retention of existing trees and provision of deep soil areas that reinforce the landscape character of the area, support tree canopy and assist with stormwater management.
O 2.4.4 The setback of development from side and rear boundaries provides a transition between sites with different land uses or intensity of development.
Clause 3.5 (Visual Privacy) and Table 3.5 of the Residential Design Codes (Volume 2)
- The development proposes balconies to units 5 and 6 that are setback 5.19m from the southern boundary. Table 3.5 stipulates that the required setback for a balcony is 6m.
Because the development does not meet the requirements of Table 3.5, the City is undertaking a “Element Objectives” assessment and is seeking feedback from adjacent landowners regarding the proposal. For your information, the Element Objectives are as follows:
O 3.5.1 The orientation and design of buildings, windows and balconies minimises direct overlooking of habitable rooms and private outdoor living areas within the site and of neighbouring properties, while maintaining dayligh and solar access, ventilation and the external outlook of habitable rooms.
