The City has received the abovementioned proposal for consideration. Prior to the City giving consideration to the proposal, comments from surrounding owners are sought.

The applicant is seeking variations to specific provisions of State Planning Policy 7.3 – Residential Design Codes (R-Codes) as outlined below:

Lot boundary setbacks - Clause 3.4.1:

In accordance with Table 3.4a a wall with a height between 3.6m and 7m requires a minimum lot boundary setback of 1.5m. The application proposes a wall height of 4.5m (measured from the neighbours natural ground level) with a setback of 1.2m in lieu of 1.5m.

Lot boundary setbacks - Clause 3.4.4:

In accordance with Table 3.4b boundary walls are not permitted adjacent to a lot with a density code of R17.5. The application proposes a boundary wall adjacent to a site with a density code of R17.5. In accordance with Table 3.4a the proposed boundary wall requires a minimum lot boundary setback of 1.5m.

Site works and retaining walls – Clause 3.5.2

In accordance with Table 3.5a retaining with a height between 1.5m and 2m requires a minimum lot boundary setback of 2m. The application proposes 1.7m high retaining on the shared boundary.
