The City has received an application for a proposed patio at 5 Sable Court, Ballajura.
The details of the proposal are as follows:
- 9m x 9.2m x 7.6m, 3.1m high L shaped patio (43 m²) on the western boundary
- Patio is to replace a similar existing patio structure
The applicant is seeking approval for a reduced setback than what is permitted “as of right” under the Residential Design Codes (R-Codes). The proposal includes the following departures:

The City has discretion to approve variations but seeks neighbour feedback as part of the assessment process.
As a result, the proposal requires an assessment against the applicable design principles which read:
Buildings set back from lot boundaries or adjacent buildings on the same lot so as to:
- reduce impacts of building bulk on adjoining properties;
- provide adequate sunlight and ventilation to the building and open spaces on the site and adjoining properties; and
- minimise the extent of overlooking and resultant loss of privacy on adjoining properties
