The City has received a development application for a proposed ‘Grouped Dwelling’ located on Lot 806 (No.6) Yenisey Crescent BEECHBORO WA 6063. The applicant is proposing an as-of-right variation to visual privacy on the east boundary. The details of the proposed development are as follows:


Site Area: 700m2 (R35)

  • Lot 1: 298.19m2
  • Lot 2: 306.87m2
  • CP: 94.94m2


Dwelling Area:

  • Proposed Unit 1: 177.55m2 (OS: 51.36%)
  • Proposed Unit 2: 178.72m2 (OS: 50.43%)

Proposed Unit 1:


  • Wall height: 2.607m
  • Roof height (overall height): 5.4m



Proposed Unit 2:

  • Wall height: 2.4m
  • Roof height (overall height): 5.4m




The as-of-right variation is:

- The property slopes down from West to East, and the finished floor level of Unit 2 on the East elevation is 0.8m (max) above NGL. Therefore, there is potential for Bedroom 1 to overlook the northern boundary and Bedroom 4 to overlook the eastern boundary.

The City will conduct an alternative merit-based assessment against the design principles of the Residential Design Codes - 3.10 Visual privacy:

Design Principles:

P3.10.1 Direct overlooking of major openings and active habitable spaces of adjacent dwellings and adjoining properties minimised through:

i. building siting, layout and design;

ii. design and location of major openings;

iii. landscape screening of outdoor active habitable spaces; and/or

iv. design and location of screening devices.


Prior to the Council giving consideration to the proposal, comments from the surrounding owners are being sought.
